Please read carefully. By purchasing this service you (herein referred to as “Client”) agree to the following terms and conditions.
PROGRAM/SERVICE
THE LIFE CONSULTANT (herein referred to as “Company”) agrees to provide the Program purchased (herein referred to as “Program”), identified on thelifeconsultant.co website and invoice. The Client agrees to abide by all policies and procedures as outlined in this agreement as a condition of their participation in the Program.
DISCLAIMER
[RIYANKA PANDITHA] (herein referred to as “Consultant”) and the Company, is not an employee, agent, lawyer, doctor, manager, public relations or business manager, registered dietician, or financial analyst, clinical psychologist or accountant. The Client understands that the Consultant has not promised, shall not be obligated to and will not; (1) procure or attempt to procure employment, business or sales for the Client; (2) perform any business management functions including but not limited to, accounting, tax or investment consulting, or advice with regards thereto; (3) act as a public relations manager (4) act as a publicist to procure any publicity, interviews, write-ups, features, television, print or digital media exposure for the Client; (5) introduce the Client to the Consultant’s full network of contacts, media partners or business partners. The Client understands that a relationship ceases to exist between the parties at the conclusion of the Program. If the Parties choose to continue their relationship, a separate agreement will be entered into.
FEES
Fees associated with the Program purchased are defined in the Welcome Email, as agreed by all parties.
METHODS OF PAYMENT
All prices listed are in AUD and can be made via thelifeconsultant.co website or an invoice will be sent out via email.
If the Client elects to pay by monthly instalments, the Client agrees to pay by the 1st of each month in the Program, over the first 3 months or dates as agreed by all parties.
If the Client elects to pay in FULL, payment must be made via thelifeconsultant.co website or invoice, prior to the first session.
REFUND POLICY
Upfront fees paid for services not rendered, will be returned to the Client if the Program is terminated prematurely. A small fee may be charged by the Consultant to cover administrative costs in addition to fees for services provided.
30-Day Money Back Guarantee
New Clients may, within 30 days of the first consultation, choose to request a full refund. Any fees paid will be returned to the Client, less administrative costs.
All decisions related to refunds will be made at the discretion of the Consultant.
RESCHEDULING POLICY
Appointments made via the online booking service can be rescheduled by the Client with no penalty, provided this is done 48 hours in advance of the initially booked appointment.
Once payment is made for a session, fees are 100% non-refundable, but session fees can be applied to an appointment at a later date.
CONFIDENTIALITY
Any personal information gathered as part of the consultation service will be kept confidentially and securely. The information is retained in order to document what happens during sessions, and enables the Consultant to provide a relevant and informed service. At any stage, the Client is entitled to access the information kept on file. The Consultant will discuss appropriate forms of access.
No information will be disclosed to other parties without written consent from the Client, with the exception of the following special circumstance;. (1) Where a Court orders the release of client information for legal purposes (2) Failing to disclose the information would place the Client or another person in serious or imminent risk. (3) Prior approval has been obtained from the Client to provide a written letter or report to another other agency (eg: GP) or discuss the material with another person (eg: parent, employer) 4. If the disclosure is required by law.
CLIENT RESPONSIBILITy
The Program is developed strictly for educational purposes. The Client accepts and agrees that the Client is 100% responsible for their progress and results from the Program. The Company makes no representations, warranties or guarantees verbally or in writing. The Client understands that because of the nature of the program and extent, the results experienced by each client may vary significantly.
SEVERABILITY/WAIVER
If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall nevertheless continue in full force. The failure of either Party to exercise any right provided for herein will not be deemed a waiver of that right or any further rights hereunder.
LIMITATION OF LIABILITY
The Client agrees that the Company will not be held liable for damages of any kind resulting or arising from including but not limited to; direct, indirect, incidental, special, negligent, consequential, or exemplary damages caused by the use of or misuse of the Company’s services or enrolment in the Program. The Company assumes no responsibility for errors or omissions that may appear in any of the program materials.
Emergency & After Hours
The Life Consultant does not operate as an Emergency or After Hours service. If you are in an emergency situation, please contact your nearest hospital emergency department, and if needed access Lifeline, which operates a 24hr crisis counselling telephone service on 13 11 14 WITHIN AUSTRALIA ONLY. If you reside outside, you take responsibility to contact your local Emergency Services.
WITHDRAWAL
The client can withdraw from consultation at any time without prejudicing any future consultation requests. All requests to withdraw need to be made via written notice (email).
The Life Consultant can withdraw from consultation at any time with verbal notice
MODIFICATION
The Company may modify terms of this agreement at any time and the Client shall be notified.
DUTY TO READ
I accept that under this agreement, I have a duty to read these terms and conditions and have done so.
